Mabo Day got its name from Eddie Koiki Mabo\, a man from Torres Strait Island who arose a campaign for Indigenous land rights. DESCRIPTION:The Nakba (Arabic: النكبة\, romanized: an-Nakbah\, ’the “disaster”\, “catastrophe”\, or “cataclysm”‘)\, also known as the Palestinian Catastrophe\, was the destruction of Palestinian society and homeland in 1948\, and the permanent displacement of a majority of the Palestinian Arabs. \nThe term is used to describe both the events of 1948 and the ongoing persecution\, displacement\, and occupation of the Palestinians\, both in the occupied West Bank and the Gaza Strip\, as well as in Palestinian refugee camps throughout the region. The foundational events of the Nakba took place during and shortly after the 1948 Palestine war\, including 78% of Mandatory Palestine being declared as Israel\, the expulsion and flight of 700\,000 Palestinians\, the related depopulation and destruction of over 500 Palestinian villages by Zionist militias and subsequent geographical erasure\, the denial of the Palestinian right of return\, the creation of permanent Palestinian refugees and the “shattering of Palestinian society”. The expulsion of the Palestinians has since been described by some historians as ethnic cleansing. In 1998\, Yasser Arafat proposed that Palestinians should mark the 50th anniversary of the Nakba declaring 15 May\, the day after Israeli independence in 1948\, as Nakba Day\, formalizing a date that had been unofficially used as early as 1949.The Nakba greatly influenced the Palestinian culture and is a foundational symbol of Palestinian identity\, together with “Handala“\, the keffiyeh and the symbolic key. DESCRIPTION:Amsterdam gebruikte hard geweld tijdens de protesten voor Palestina. Hoe ondermijnt dit het recht op demonstratie? En wat is de rol van de media? \nDemonstranten in Amsterdam protesteerden tegen samenwerking van de UvA met Israëlische instellingen\, vanwege de zich afspelende terreur op Palestijnen in Gaza. Volgens VN-rapporteur Francesca Albanese zijn daar “redelijke gronden om aan te nemen dat de drempel die het plegen van de misdaad van genocide aangeeft\, is bereikt”. Genocide is door de Verenigde Naties unaniem aangenomen als ernstig misdrijf tegen de mensheid. Artikel 90 van de Nederlandse grondwet gebiedt dat “de regering zich actief inzet voor de bevordering van de internationale rechtsorde”. In Artikel 9 staat dat “iedereen en iedere groep het recht [heeft] om in het openbaar bij elkaar te komen\, bijvoorbeeld voor een vergadering of een betoging of een demonstratie”. Toch vond tijdens de protesten buitenproportioneel politiegeweld plaats op last van de driehoek: de Amsterdamse burgemeester\, officier van justitie en politiechef. Tijdens het uitoefenen van hun recht op geweldloze demonstratie in de publieke ruimte heeft de politie ook bezoekers\, stagiairs en medewerkers van Pakhuis de Zwijger geslagen. Hoe verhouden de keuzes van de Nederlandse en Amsterdamse overheid zich tot het internationaal recht en de grondwet? Wat betekent het als het democratische recht op demonstratie wordt geschonden? En wat zijn de gevolgen als media schendingen van Artikel 9 en 90 onderbelicht laten? DESCRIPTION:De politie is in 2023 bij ruim drie miljoen incidenten ter plaatse geweest\, bij die incidenten hebben politiemedewerkers in totaal 35.542 keer geweld toegepast\, dat is 5 procent meer dan in 2022. \nDit blijkt uit cijfers die de politie bijhoudt. ‘Als politie zijn we uitvoerder van het geweldsmonopolie\, het is cruciaal dat we transparant zijn over het toepassen van geweld\,’ zegt portefeuillehouder Frank Paauw. Geweld is er in verschillende vormen. Ook het boeien van een verdachte of het intrappen van een deur is een aanwending van geweld. Zware vormen zoals het gebruik van het vuurwapen of geweld waarbij een verdachte meer dan licht lichamelijk letsel oploopt\, worden apart geregistreerd. Daarvan waren er in 2023 2421 registraties\, een kleine daling ten opzichte van een jaar eerder. Bij dat soort incidenten wordt altijd gekeken of een politiemedewerker professioneel gehandeld heeft of niet. Bij 343 gevallen bleek dat niet het geval te zijn geweest. ‘Dat is 16 procent. Daarin zien we een stijging\,’ merkt Paauw op. ‘Het toont onder meer aan dat we kritisch zijn op ons handelen. Dat is positief. De maatschappij mag verwachten dat we geweld rechtmatig en zorgvuldig toepassen.’ ‘De burger mag ook verwachten dat we als politie leren van onze fouten\,’ zegt Paauw. \n‘Kunnen we zorgvuldiger optreden\, kunnen we geweld voorkomen? Daaraan besteden we veel aandacht tijdens de opleiding en verplichte trainingen. Bijvoorbeeld dat politiemedewerkers duidelijk moeten waarschuwen voordat ze een geweldsmiddel in zetten. Dat kan verdere escalatie voorkomen. Verder hebben we de benaderingstechniek voor mogelijk gevaarlijke verdachten aangepast. Daarbij trokken in het verleden politiemedewerkers standaard hun wapen\, nu maken ze daar eerst een afweging voor.’ Politiemedewerkers gebruikten vorig jaar 1888 keer hun vuurwapen. In de meeste gevallen (1226) ging het daarbij alleen om richten om te dreigen. Agenten hebben 162 gerichte schoten afgevuurd\, in 129 situaties was sprake van het doden van een ernstig gewond dier. Het is van belang dat politiemedewerkers geweld zorgvuldig registreren\, zegt Paauw. ‘Dat maakt inzichtelijk welke vormen van geweld worden toegepast en waar we wat kunnen leren.’ Momenteel loopt er een onderzoek naar het registreren van geweld. DESCRIPTION:Als nazaten van genocide\, verdrijving en onderdrukking voelt een groep Armeense\, Joodse\, en Palestijnse Nederlanders zich geschoffeerd door de Nederlandse houding\, die wil dicteren wie en op welke manier mogen worden herdacht\, en sluit zich aan bij de alternatieve herdenking op 3 mei 2024 omdat zij zich niet welkom voelt op de dodenherdenking. \nDe Nederlandse overheid heeft afgeroepen om de herdenking in capaciteit te halveren en om iedereen te fouilleren. De 10.000 mensen die nu worden geweerd\, zijn van harte welkom bij de herdenking “Knuffels\, bloemen en kaarsen”. De herdenking vindt plaats tussen het Anne Frank huis en het homomonument\, op 3 mei tussen 18:00 en 19:30. De herdenking is een burgerinitiatief bestaande uit een brede groep vrijwilligers met diverse achtergronden. Zij vindt het ongepast dat de staat wil bepalen hoe mensen een plek geven aan hun rouw. DESCRIPTION:Driekwart van alle voedselreclame in Nederland is voor junkfood\, Foodwatch eist nú een harde wet die alle vormen van marketing voor ongezonde voedingsmiddelen gericht op kinderen tot 18 jaar verbiedt. \nFoodwatch luidt de noodklok: kindermarketing voor ongezonde voedingsmiddelen is niet alleen onverantwoordelijk\, het is een gevaar voor de volksgezondheid. Onze jeugd wordt ondanks vrijwillige afspraken en zelfregulering dagelijks geconfronteerd met een stortvloed aan reclames voor voedingsmiddelen die bijdragen aan overgewicht – een probleem waar nu al 15% van de kinderen in Nederland mee kampt. In sommige wijken is dit zelf een op de drie kinderen. Deze epidemie van overgewicht verergert\, zelfregulering via de Reclame Code Commissie en afspraken uit het Nationaal Preventieakkoord helpen totaal niet om het tij te keren. De harde feiten liegen er niet om: het percentage kinderen met overgewicht daalt niet significant – zelfs met de huidige afspraken blijft het steken op 14% tegen 2040. Het beleid faalt en geeft de sluwe voedingsindustrie\, met hun miljardenbudgetten voor junkfoodmarketing\, vrij spel. Reclamecodes en zelfregulering zijn niet genoeg om onze kinderen te beschermen tegen de agressieve tactieken van deze bedrijven. Strijd mee en teken de petitie. DESCRIPTION:A collaboration from International Consortium of Investigative Journalists (ICIJ) and media partners in Latin America\, Europe and the United States documents nearly 19\,000 migrants’ journeys to the U.S. border under dangerous conditions. \n“Cargo trucks: a trap for migrants\,” is a reporting collaboration led by Noticias Telemundo and the Latin American Center for Investigative Journalism (CLIP)\, with the ICIJ and Bellingcat. Pie de Página and its partners Chiapas Paralelo and En un 2×3 Tamaulipas reported in Mexico\, Plaza Pública in Guatemala and Contracorriente in Honduras. In December 2021\, 31-year-old Rafelín Martínez Castillo left the Dominican Republic for Panama\, traveling to Guatemala before crossing the border into Chiapas\, Mexico’s southernmost state. His family had paid $26\,000 to smugglers who had agreed to get him to the United States. Instead\, 25 days after leaving home\, the craftsman returned in a casket. Martínez Castillo was one of 56 people killed when an 18-wheeler that had been carrying dozens of migrants overturned on a Chiapas highway. Images of the tragic scene spread around the world and the day after the accident\, officials from six countries\, including Mexico and the United States\, announced a new action group to investigate. But what could have been a turning point in curtailing the dangerous smuggling of migrants instead became an example of systemic failures. The action group only met once\, in January 2022\, and never released a report. Those cases represent only a small fraction of the millions of journeys to the U.S. border annually. “The situation of displaced people is so grave that they take all these risks\,” said Tonatiuh Guillén López\, Mexico’s former immigration chief who resigned in 2019 over disagreement with the government’s shifting immigration policies. He is one of several current and former Mexican officials that reporters interviewed — along with survivors\, experts\, migrants’ rights advocates and others — for the investigation. DESCRIPTION:Lost in Europe\, a cross-border journalism project investigating missing child migrants in Europe has uncovered a shocking figure of 51\,433 children who disappeared after arriving in European countries between 2021 and 2023. \nOver the past few months\, Lost in Europe has gathered data from various European countries\, focusing on the disappearances of unaccompanied minors. Specifically\, their analysis encompasses 2021\, 2022\, and 2023\, categorising the missing minors by their country of origin\, gender\, and age. Out of 27 EU countries\, plus Moldova\, Norway\, the UK\, and Switzerland\, only 20 responded to their inquiries\, and just 13 provided data. According to the available data\, Italy has the highest number of registered missing unaccompanied minors\, with 22\,899\, followed by Austria (20\,077)\, Belgium (2\,241)\, Germany (2\,005)\, and Switzerland (1\,226). The number of missing children may be even higher because the data is often inconsistent and incomplete\, and many countries in Europe do not even collect data on missing unaccompanied minors. These figures have been described as “worrying” by Aagje Ieven\, Secretary General of Missing Children Europe. \n“The increased number of reports on missing unaccompanied minors serves as a sharp reminder of the giant iceberg that looms beneath the surface\,” Ieven told Lost in Europe. Previously\, in 2021\, Lost in Europe found that at least 18\,000 unaccompanied minors had disappeared after arriving in Europe between 2018 and 2020. DESCRIPTION:Media freedom and pluralism is flailing across Europe\, and in some countries\, are on its last legs. \nThe European Media Freedom Act will bring some improvements\, but on its own is not enough to rescue a struggling media landscape. Liberties Media Freedom Report 2024 reveals that media freedom and media pluralism are close to breaking point in many EU countries\, while in others\, a near-total overhaul is required to address chronic\, systemic issues with only a limited number of exceptions. The continued erosion of media freedom is evidenced by widespread harassment of journalists and governments restricting access to information. Meanwhile\, heavy media ownership concentration and threats to the independence and finances of public service media contribute to a shrinking media plurality. A diverse and free media environment is crucial for democracy because we rely on independent news outlets to hold our politicians accountable and keep us informed. DESCRIPTION:With ever-growing needs for minerals that are critical for renewable energy technologies\, Secretary-General António Guterres is leveraging the United Nations’ convening power to bring together a diverse group of governments and other stakeholders across the entire minerals value chain to develop a set of global common and voluntary principles to safeguard environmental and social standards and embed justice\, in the energy transition. \nA Panel on Critical Energy Transition Minerals — co-chaired by Ambassador Nozipho Joyce Mxakato-Diseko of South Africa and Director-General for Energy Ditte Juul Jørgensen of the European Commission — will address issues relating to equity\, transparency\, investment\, sustainability and human rights. Limiting global warming to 1.5 degrees Celsius\, to avert the worst impacts of climate change\, will depend on the sufficient\, reliable and affordable supply of critical energy transition minerals such as copper\, lithium\, nickel\, cobalt and rare earth elements\, which are essential components of clean energy technologies – from wind turbines and solar panels to electric vehicles and battery storage. At COP28\, governments agreed to triple renewable energy capacity by 2030. There is no pathway to achieving this goal without a significant increase of supply of critical energy transition minerals.  According to the International Energy Agency\, mineral demand for clean energy applications is set to grow by three and a half times by 2030 on the pathway to reaching global net zero carbon dioxide emissions by 2050. Developing countries with large reserves of critical energy transition minerals have an opportunity to transform and diversify their economies\, create green jobs\, and foster sustainable local development. However\, mineral resource development has not always met this promise. \nWithout proper management\, increased demand for these minerals risks perpetuating commodity dependence\, exacerbating geopolitical tensions\, and poses environmental and social challenges with adverse impacts on sustainable development including on livelihoods\, the environment\, health\, human security and human rights. Responding to calls from developing countries for globally agreed guidance to ensure responsible\, fair and just value chains\, the UN-convened Panel brings together governments\, intergovernmental and international organizations\, industry\, and civil society to build trust\, guide the just transition and accelerate the race to renewables. DESCRIPTION:The Israel-Gaza war has taken a severe toll on journalists since Hamas launched its unprecedented attack against Israel on October 7 and Israel declared war on the militant Palestinian group\, launching strikes on the blockaded Gaza Strip. \nThe Committee to Protect Journalists (CPJ) is investigating all reports of journalists and media workers killed\, injured\, or missing in the war\, which has led to the deadliest period for journalists since CPJ began gathering data in 1992. As of April 26\, 2024\, CPJ’s preliminary investigations showed at least 97 journalists and media workers were among the more than 35\,000 killed since the war began on October 7—with more than 34\,000 Palestinian deaths in Gaza and the West Bank and 1\,200 deaths in Israel. The Israel Defense Forces (IDF) told Reuters and Agence France Press news agencies in October that it could not guarantee the safety of their journalists operating in the Gaza Strip\, after they had sought assurances that their journalists would not be targeted by Israeli strikes\, according to a Reuters report. Journalists in Gaza face particularly high risks as they try to cover the conflict during the Israeli ground assault\, including devastating Israeli airstrikes\, disrupted communications\, supply shortages\, and extensive power outages. As of April 25\, 2024: \n\n97 journalists and media workers were confirmed dead: 92 Palestinian\, 2 Israeli\, and 3 Lebanese.\n16 journalists were reported injured.\n4 journalists were reported missing.\n25 journalists were reported arrested.\nMultiple assaults\, threats\, cyberattacks\, censorship\, and killings of family members.\n\nCPJ is also investigating numerous unconfirmed reports of other journalists being killed\, missing\, detained\, hurt\, or threatened\, and of damage to media offices and journalists’ homes. The list published here includes names based on information obtained from CPJ’s sources in the region and media reports. It includes all journalists* involved in news-gathering activity. It is unclear whether all of these journalists were covering the conflict at the time of their deaths\, but CPJ has included them in our count as we investigate their circumstances. DESCRIPTION:Een onderzoek naar de positie van burgers die hulp boden toen de overheid tekortschoot. \nWat mag een burger van de overheid verwachten wanneer de overheid tekortschiet? Het rapport ‘Verboden hulp te bieden?‘ gaat over de positie van burgers die hulp boden aan asielzoekers bij het Aanmeldcentrum ter Apel. In de zomer van 2022 was er in en rond het aanmeldcentrum in Ter Apel een crisissituatie. Een groep asielzoekers moest zonder onderdak en bescherming buiten wachten en overnachten omdat er geen plek voor hen was in het aanmeldcentrum. Verschillende burgers zagen dat de overheid tekortschoot en voelden zich genoodzaakt tenten en andere hulpmiddelen uit te delen. Overheidsinstanties reageerden hierop door de tenten en hulpmiddelen af te pakken en dreigden burgers die te hulp schoten met strafrechtelijk ingrijpen. Twee organisaties\, MiGreat en Doorbraak\, dienden bij de ombudsman klachten in over het optreden van de gemeente Westerwolde en de politie. Verder klaagden zij erover dat hun klachten door deze overheidsinstanties niet in behandeling waren genomen. De ombudsman concludeert in het rapport dat het optreden van de overheid richting burgers die hulp boden aan asielzoekers op het grasveld bij Ter Apel in de zomer van 2022 niet behoorlijk en ongepast was. DESCRIPTION:De Afdeling bestuursrechtspraak vernietigt het besluitmoratorium van 19 december 2023 dat de demissionair staatssecretaris Van der Burg (Asiel) heeft afgekondigd voor (staatloze) vreemdelingen uit de Palestijnse gebieden. \nDe staatssecretaris heeft het moratorium niet goed gemotiveerd\, omdat dit niet op de meest actuele informatie is gebaseerd. Daardoor is hij onvoldoende ingegaan op de ontwikkelingen die tot 19 december 2023 hebben plaatsgevonden. Dat oordeelt de Afdeling bestuursrechtspraak in een uitspraak van 24 april 2024. SUMMARY:Armeense genocide 1915 - herdenking / Genocide Memorial Day 2024
DESCRIPTION:De Armeense genocide (Armeens: Հայոց Ցեղասպանութիւն\, Hayots tseghaspanutyun)\, Turks: Ermeni Soykırımı)\, door Armeniërs traditioneel aangeduid met Medz Yeghern (Armeens: Մեծ Եղեռն\, “Grote Misdaad”)\, is de naam voor de volkerenmoord gepleegd op tussen de 1 en 1\,5 miljoen Armeniërs in het Ottomaanse Rijk ten tijde van het regime van de Jonge Turken. \nDe startdatum is 24 april 1915\, de dag dat de Ottomaanse autoriteiten ongeveer 250 Armeense intellectuelen en leiders van de gemeenschap in Istanboel oppakten en arresteerden. De genocide werd tijdens en na de Eerste Wereldoorlog in twee fases uitgevoerd: het grootschalig doden van de weerbare mannelijke bevolking door middel van massamoord en onderwerping van het leger van dienstplichtigen tot dwangarbeid\, gevolgd door de deportatie van vrouwen\, kinderen\, ouderen en zieken die op dodenmarsen moesten tot de Syrische Woestijn. De gedeporteerden werden verstoken van voedsel en water en onderworpen aan diefstal\, verkrachting en moord. Ook andere inheemse en christelijke etnische groepen werden op dezelfde wijze gericht uitgeroeid door de Ottomaanse regering. De genocide was niet alleen gericht tegen de Armeniërs. Zo werden ook Arameeërs (Shabo\, de genocide op Arameeërs in het kort\, 2018)\, Grieken en Assyriers het slachtoffer van deze genocide. \nDe Armeense genocide wordt gezien als een van de eerste moderne genocides\, omdat geleerden wijzen op de georganiseerde wijze waarop de moorden op de Armeniërs werden uitgevoerd\, en het is het tweede meest bestudeerde geval van genocide na de Holocaust. Robert Fisk stelt in zijn boek “De grote beschavingsoorlog” dat de Armeense genocide een voorloper van de Holocaust was\, waarbij ook enkele Duitsers betrokken waren. De nazi’s zouden deze uitroeiings- en verzwijgingstactieken enige decennia later opnieuw toepassen. Winston Churchill waarschuwde herhaaldelijk tegen deze praktijken: “De geschiedenis zal vruchteloos speuren naar het woord ‘Armenië’.” Een deel van de historici\, inclusief verschillende Turkse historici\, zoals Taner Akçam\, Fatma Muge Gocek en Halil Berktay en de vermoorde Hrant Dink\, zijn het over het algemeen eens dat een genocide plaatsvond. \nEen ander deel van de historici\, waaronder enkele Westerse historici die gespecialiseerd zijn in de geschiedenis van het Ottomaanse Rijk zoals Bernard Lewis\, Justin McCarthy en Gilles Veinstein\, houden het bij deportatie en massamoord van Armeniërs\, waarbij vaak etnische zuivering wordt erkend. Echter vinden zij het niet uitermate afwijken van andere totalitaire oorlogssituaties en het niet vergelijkbaar met bijvoorbeeld de Holocaust. De internationale discussie richt zich vooral op wat de precieze definitie van genocide is en wie in deze bepaalt dat ze hier daadwerkelijk van toepassing is. Turkije\, de staat die het Ottomaanse Rijk opvolgde\, ontkent dat het woord genocide een goede term is voor de massamoord op Armeniërs die in 1915 begon onder de Ottomaanse heerschappij. In Turkije wordt de genocide dan ook vaak de Armeense kwestie genoemd. Andere landen hebben de massamoord officieel erkend als genocide (de Nederlandse overheid doet dat overigens tot nog toe niet)\, een standpunt dat wordt gedeeld door de meeste geleerden en historici. \nLinks:\nArmenian Genocide

DESCRIPTION:The European Court of Human Rights (ECtHR) delivered Grand Chamber rulings in the cases of Verein KlimaSeniorinnen Schweiz and Others v. Switzerland\, Carême v. France and Duarte Agostinho and Others v. Portugal and 32 Others on 9 April 2024. \nThe ECtHR ruled on three climate cases. In Klimaseniorinnen Schweiz and Others v Switzerland\, a group representing more than 2\,500 older Swiss women argued that their government’s failure to adequately mitigate global warming violated their human rights to health and life and puts them at risk of dying during heatwaves. \nIn Duarte Agostinho and Others v Portugal and 31 Other States six young Portuguese people argued that countries bound by the European Convention on Human Rights — the 27 EU states\, as well as the United Kingdom\, Switzerland\, Norway\, Russia and Turkey — had infringed several human rights after heatwaves and forest fires closed down their schools and risked their health. Amnesty International submitted a joint third-party intervention in the case on the obligation on governments to create climate policies which protect the rights of people outside their borders. \nIn the third case\, Damien Carême\, a former mayor of Grande-Synthe\, a suburb of Dunkirk in northern France\, argued that the French government has neglected its obligation to protect life by failing to take sufficient steps to prevent climate change and therefore heightening the risk of future flooding in the area. \nThe right to a clean\, healthy and sustainable environment was universally recognized by the UN General Assembly in 2022. Amnesty International is part of a coalition calling for the adoption of an additional protocol on the right to the European Convention on Human Rights which would help reinforce and clarify the ECtHR’s jurisprudence on environmental protection\, including climate change.
